Overview and acceptance
Vanitas, a Specie house is operated by PaintedApp, LLC. Vanitas (“we,” “us,” “our”) sells still-life pictures of contemporary objects, made with an image model at our direction and printed as giclée prints on canvas and paper, at specie-vanitas.vercel.app. It also paints proofs of a table you lay yourself and prints them as commissions. By using the site you agree to these terms. If you do not agree, do not use the site.
Eligibility
You must be at least 18 years old, or the age of majority where you live, to buy from us or to upload a photograph.
The pictures, and what they are
Every picture on this site is generated by an image model from a description written by Vanitas, and checked by a person before it is offered. A canvas is a giclée print on canvas, gallery-wrapped; a paper proof is a giclée print on Hahnemühle Photo Rag. Nothing is hand-painted, hand-signed or gilded. Because of how copyright law treats AI-generated images, the pictures may not be eligible for copyright protection; to the extent they are, they remain ours, and buying a print licenses that copy for personal display only.
Every maker’s name on a Vanitas table is invented. Vanitas is independent and is not affiliated with, sponsored by or endorsed by any maker of watches, cards, cars, wine, bags, hotels or anything else that resembles an object in a picture. The paintings are satire about the objects themselves.
Editions and numbering
Each of the twelve pieces is an edition of 25 canvases across all canvas sizes. Numbers are assigned in the order payments clear, and the ledger at /ledger and each piece page show every number sold. A refunded number is struck, retired and never sold again, so an edition can close with fewer than 25 canvases sold. If two payments clear inside the same moment for the last copy, the later buyer is refunded in full and told so. Paper proofs are an open edition and are not numbered. Commissions are numbered separately and do not count toward any edition of 25.
Proofs and commissions
Each browser may paint 3 free proofs of a table it lays. A proof is watermarked and is for your own viewing; it may not be used commercially. A commission is the canvas price plus $600, and the canvas is printed from the proof you saw, without the watermark.
If you add a photograph of an object you own, you represent that you own it or have the right to photograph it, that no person appears in it, and that it shows no document, card number or other personal information. We run a safety check on it before anything is painted and refuse what fails. Any logo, wordmark or maker’s name on the object is painted out. We do not keep the photograph after the proof is painted; we keep the proof so it can be printed. We do not use your photographs to train models, and we do not sell or share them.
Orders and payment
- All prices are in US dollars, and insured freight within the United States is included.
- We ship within the United States. For other destinations, write before ordering.
- Payment is taken by Stripe at checkout. Promotion codes, where offered, are entered there.
- Prints are produced to order by our fine-art lab, Prodigi, and shipped from the lab.
Refunds and returns
Prints are made to order and are not returnable for a change of mind. A print that arrives damaged, defective or different from what you ordered is reprinted or refunded in full; write within 30 days of delivery with a photograph. The full policy, and the hour in which an order can be cancelled, is on Refunds and Returns.
Because every print is made to order, EU and UK consumers acknowledge that the statutory 14-day right of withdrawal does not apply once production has begun, except where a product arrives damaged or defective.
Acceptable use
You agree not to:
- upload a photograph you have no right to, or one showing a person;
- upload anything illegal, hateful or explicit;
- try to get around the proof limit or the safety check, or paint proofs by automated means;
- resell proofs or prints, or present them as hand-made.
Indemnification
You agree to indemnify and hold harmless PaintedApp, LLC and its operators from claims, damages and expenses, including reasonable legal fees, arising from a photograph you upload, your breach of these terms, or your infringement of anyone’s rights.
Disclaimer of warranties
The site and its pictures are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or that a proof will match a particular expectation.
Limitation of liability
To the extent the law allows, PaintedApp, LLC is not liable for indirect, incidental, special or consequential damages, and its total liability for any claim is limited to what you paid for the affected order. Some jurisdictions do not allow these limits, so some may not apply to you.
Copyright and DMCA
If you believe something on this site infringes your copyright, send a notice to support@painted.app with the work, the material and where it is, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. We respond to valid notices and remove material where warranted.
Governing law and disputes
These terms are governed by the laws of the State of Oregon, USA, without regard to conflict-of-laws rules. Please write to us first; a dispute we cannot settle informally goes to the state or federal courts in Oregon, except that either party may bring a qualifying claim in small-claims court.
Changes and general
We may update these terms. Changes are posted here with a new date and listed on Legal and changes. If a provision is unenforceable, the rest stands. These terms and the Privacy Policy are the whole agreement between us.
